Membership Terms and Conditions

Welcome to the My Petcare Community. Please read the following Membership Terms & Conditions (Membership Terms). They govern your (your or you) use of the My Petcare Community (Site) as a member.

These Membership Terms and Conditions are entered into by and between You and Bisson Barcelona, LLC/My Petcare Community (hereafter “Website”, “Site”, “Company”, “I”, “We”, “Me”, “My” “Us”, “Our”) for the purpose of having access to and using My Petcare Community and its online courses (hereafter, “online course”, “Course”) hosted on the WordPress and LearnDash platform. 

Once you click “I agree”, you agree to the Membership Terms as a legally binding contract between you and Bisson Barcelona, LLC. If you do not want to agree to these Membership Terms, we are sorry, but our friendship will have to end there!

1. Payment Plan Agreement Contract

MONTHLY PAYMENT PLAN MEMBERSHIPS

Applies to memberships where payments are made every month during the duration of the membership term.

You understand and agree that you have committed to a contract. And you agree to membership fees payable by you at the rate offered at purchase time every month for a period of 12 months to access the community site for a period of 1 year if you purchase any 1 year duration payment plan membership.

Cancellation of MONTHLY PAYMENT PLAN

You can cancel your monthly membership at any time with a monthly payment plan through the My Account Dashboard. Your membership will remain in effect through the end of your monthly payment plan and then will not renew. Questions? Please email team@mypetcarecommunity.com

If our community is not for you, you are able to cancel your monthly membership in the first 30 days for a full refund – as per our 30-day Moneyback Guarantee. Please email team@mypetcarecommunity.com to cancel. You understand that should you cancel your monthly membership outside of the first 30 days, no refund will be provided.

YEARLY PAYMENT PLAN MEMBERSHIPS

Applies to memberships where payments are made every year during the duration of the membership term.

You understand and agree that you have committed to a contract. And you agree to membership fees payable by you at the rate offered at purchase time every year to access the community site for a period of 1 year if you purchase any 1-year duration payment plan membership.

Cancellation YEARLY PAYMENT PLAN

You can cancel your yearly membership at any time with a yearly payment plan through the My Account Dashboard. Your membership will remain in effect through the end of your yearly payment plan and then will not renew. Questions? Please email team@mypetcarecommunity.com

If our community is not for you, you are able to cancel your yearly membership in the first 30 days for a full refund – as per our 30-day Moneyback Guarantee. 2. Membership

If you are under 18 years, you need your parents’ permission before becoming a member and accessing the Site.

Your Membership is non-transferable. You must not share your username and password with anyone else or allow anyone else to access the Site using your username and password.

You are responsible for every use of the Site that occurs in conjunction with use of your username and password. You must use reasonable efforts to keep your username and password confidential. You must notify us as soon as you become aware of any unauthorized use of your membership, username or password.

Membership is based on periodic subscription fees which are detailed on the Site’s sign up page. Your membership, or access to Content and areas of the Site, will be suspended or cancelled if we do not receive the fees for your subscription type.

You can ask for a refund of subscription fees under our “Moneyback Guarantee” policy, during the first 30 days of your subscription. You may also have rights granted to you by law which may entitle you to a refund of fees in specific circumstances. Apart from those things, refunds of subscription fees will not be made.

3. Privacy Policy

Your access and use of this Site also signifies your acquiescence and agreement to our Privacy Policy. The Privacy Policy governs our process of collecting information and data and outlines how and for what purpose we use such data. Our Privacy Policy governs both your use and access to our Site and to our Course. If you do not agree with the entirety of our Privacy Policy, do not access/use our Site, and Course. 

The Site and this Course are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site without parental permission.

If you do not agree with all these Terms of Use, then you must not access the Site, this Course or click on any links or use the Site and Course in any way. 

4. Disclaimer

Your use of and access to our online course is subject to Our Disclaimer. You can read our Disclaimer policy, which governs the Site at https://mypetcarecommunity.com/mpcc-disclaimer-policy/ online course and your use of it on the platform the Course is on. The Disclaimer informs users and visitors of the Site and online course of various limitations regarding the information provided on the Site. 

Aside from regular Disclaimer covering our Site limitations, affiliations, and product use, this particular Disclaimer section complements our Site Disclaimer by adding certain specific clauses to cover categories regarding our My Petcare Community online course.  By agreeing to the Terms of Use, you’re also acknowledging and agreeing with the Site Disclaimer and this additional Disclaimer section. 

The Course Provides No Guarantees

When you access and use our My Petcare Community course, you acknowledge, understand and agree that We do not promise any guarantees or typical results.

Each individual’s results will vary. What one person will accomplish from this Course is not representative of what you will achieve from it. You accept that We, our Site, and Online Course are not making any guarantees, and your access and use of this Course is an act of acknowledging and understanding fully that your results may vary

Third-Party Affiliates and Sponsors

Our online course, at the My Petcare Community may make product and software recommendations during the duration of the Course. It may be possible that we are affiliated with those Third-Party companies. This means that if you make any purchase, subscribe for a service or rent any equipment through our links, then we will get a small commission at no extra expense to you. If a link is an affiliate link, you will know about it, because we will clearly say so. 

Regardless whether we are affiliated or partnered with any Third-Party companies or products, we will never recommend a product or service that we don’t believe and like. However, you acknowledge, agree and accept that we are not liable for any Third-Party products or services, and do not have any responsibility as to your access, use and opinion of the product/service. 

5. Content for Educational and Informational Purposes Only 

Any downloads, articles, and resources provided in the Course and through the Course platform are solely provided for educational and informational purposes only. Nothing provided in and through the Course should be construed as legal, medical, financial, tax, or any other professional advice. 

6. Availability and Use of the Site

The Site will usually be available 24 hours a day, seven days a week. We may, however, need to interrupt or suspend your access to the Site or the provision of the Site’s services and Content, for maintenance, technical or other reasons.

When accessing and using the Site and its services and Content, you must comply with directions, instructions or protocols posted on the Site.

We are pleased to be able to offer a wide range of exclusive Content on the Site for your educational and learning needs, which we aim to constantly add to. The Content will be updated, changed, or removed from time to time, at our discretion, so we can’t guarantee that specific Content will always be available on the Site.

7. Intellectual Property 

This Site/Company and My Petcare Community is our proprietary property unless otherwise indicated. We have complete ownership and control of any source code, databases, functionality, software, website designs, audio, video, text, photographs, course content, videos, tutorials, worksheets, workbooks, and graphics on the Site and Online Course and the trademarks, service marks, and logos contained therein (hereafter “Marks”). The Content and Marks are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions. 

As a visitor and user of this Site, and a person who purchased a membership or course, you are given a limited license and are not permitted to break the boundaries of that license. 

My Petcare Community and all of its contents, videos, worksheets, workbooks, tutorials, email lists, email, and any other content or information pertaining to the Site and Course in any way is considered an Intellectual Property. 

This Intellectual Property belongs wholly and unequivocally to our Website and Bisson Barcelona, LLC. We have complete and sole ownership over the Site and Course and anything related to it unless otherwise specified. 

No Unauthorized Copying/Reproducing of Course Materials

As a purchaser of the Membership and Course, you’re given limited license to access and use the course. You do not have ownership of any Intellectual Property related to the Course. You are forbidden from making copies, reproductions, or any kind of replication of the Course. You do not have the right to transfer the access to the Course to another person. 

License to access and use the course is granted to each paying customer only. Should we discover that you reproduced, copied, sold, licensed out, leased, rented or transferred the Course to another person or entity, we reserve the right to seek remedies. 

8. Fair use and prohibited conduct

You are permitted to download Content to your computer as part of your membership. But your membership is subject to a ‘fair use’ policy. Our ‘fair use’ policy requires that your use of the Site and the Content must be fair, genuine, and reasonable. For example, the total amount of Content you download must be reasonable in light of your genuine education and learning needs, and the time needed to genuinely engage with the Content. We will use our reasonable discretion to decide whether a member has complied with the ‘fair use’ policy.

You must not use scripts to automatically mass download Content.

You also must not:

  1. use a false email address, impersonate others, or misrepresent your affiliation with others;
  2. insert advertising, branding or other promotional content into the Site or Content;
  3. attempt to gain unauthorized access to computer systems or materials through the Site;
  4. engage in automatic gathering of information from or through the Site (such as “spidering”, “screen scraping”, “database scraping” or harvesting of e-mail addresses);
  5. attempt to interrupt or alter the Site’s operation in any way (for example through sending mass unsolicited messages, “flooding” servers, or introducing a virus, time bomb, trojan horse, worm, cancelbot or other computer routine);
  6. use the Site or the Content in a way that violates applicable law, that violates third party intellectual property or other rights, or that is, fraudulent, obscene, offensive, or defamatory; or
  7. except as allowed in these Membership Terms, copy, distribute, transmit, modify or otherwise exploit the Content or any other data or code made available through the Site.

9. Intellectual property complaints

We respect the intellectual property rights of others and require that you do the same.

Please contact us if you believe that your intellectual property or other rights are being affected by anything on the Site.

If you are specifically making a copyright-based claim regarding Content, please forward the following information to us:

  1. your address, telephone number, and email address;
  2. a description of the location of the alleged infringing material;
  3. a description of the copyright work that has been allegedly infringed; and
  4. a statement by you that you warrant that the information given in your claim is accurate and that you are either the copyright owner or are authorized to act on the copyright owner’s behalf.

10. Forum and community rules

Please read our Forum and Community rules, which are part of these Membership Terms and apply to content contributed to the Sites by members (such as comments, reviews and forum posts).

We reserve the right, but are not obliged, to monitor all matter posted to the Site. We are not responsible or liable for material posted by others. We do, however, reserve the right to edit, refuse to post or to remove matter that in our discretion is objectionable or in violation of these Membership Terms, our policies or applicable law.

You must not upload or post any materials that:

  1. restrict or inhibit others’ use or enjoyment of the Site;
  2. are false, misleading, fraudulent, unlawful, abusive, harassing, defamatory, obscene, vulgar, or offensive;
  3. infringe others’ rights, including privacy or intellectual property rights;
  4. disclose personal information about others, particularly sensitive information;
  5. contain a virus, spyware, or other harmful component; or
  6. contain commercial solicitation or ‘spam’ of any kind.

11. Refusal, suspension, or termination of membership

We may, in our discretion, immediately restrict, suspend, or terminate your membership and access to the Site if we consider you in breach of these Membership Terms, any other Site rules, or applicable law.

We reserve the right to refuse membership in our discretion (examples include previous breaches of membership terms on any of our websites and previous utilization of the Site’s “Moneyback Guarantee”).

12. Liability and disclaimer

Except as provided in an applicable Non-excludable Law, we are bound only by the express promises made in these Membership Terms and are not bound by implied terms.

Except as provided in an applicable Non-excludable Law:

  1. we do not promise that the Content or your access to the Site will be uninterrupted or error-free, that any defects will be corrected, or that the Site or Content are free of viruses or any other harmful components; and
  2. we make no promises regarding your access to, or the results of your access to, the Site or Content in terms of correctness, accuracy, timeliness, completeness, reliability or otherwise.
  3. Except as provided in an applicable Non-excludable Law, we and our affiliates are not liable for indirect, incidental, special or consequential damages, loss or revenue or loss of profits which result from any use of or access to, or any inability to use or access, the Site.

13. Changes to Membership Terms

We may change these Membership Terms from time to time, but we will notify members before doing so. You will be given the opportunity to cancel your subscription with a pro-rata refund (based on time remaining in your subscription) if you do not want to accept the changes. If you do not opt out in this way, your continued subscription to and use of the Site will be an acceptance of the updated Membership Terms.

14. Applicable Laws

These Terms of Use and your access and use of our Membership Site, Course and Course platform are governed by and construed in accordance with the laws of the United States and the State of New Hampshire.

15. Binding Arbitration 

If a dispute arises between You and Our Company and or Website, and if You and Us are unable to resolve the Dispute through informal negotiations, then the Dispute will be finally and exclusively resolved by binding arbitration. Any arbitration will take place in the State of New Hampshire only. You further agree that you shall be responsible for all costs associated with initiating the arbitration and for the administration of the arbitration. 

16. International Users 

This Course and these Terms of Use are controlled, operated, and administered by Our Company and Website located in the State of New Hampshire, United States of America (“USA”). If you access the Website and services from a location outside of the USA, then you are responsible to comply with all the local laws. You acknowledge and agree that you may not access and use this Website and its contents and services in any way, manner or country prohibited by applicable laws and regulations. 

17. No Joint Venture or Partnership 

No Joint Venture or Partnership/Agency relationship is created between You and Us by your access and use of the Website and the Course, and by these Terms of Use. You further agree that these Terms of Use will not be construed against us simply because we drafted them. You waive any and all defenses you may have based on the electronic form of these Terms of Use and the fact that they are not signed by the parties. 

18. Refunds, Returns, and Subscription Cancellations Policy

You will absolutely love our products and services. However, you’re fully protected by a 100% money-back return policy.

Here’s how it works…

First 30 Days

If you are dissatisfied at any time during the first 30 days after purchase, simply delete all digital files, including video, audio, and text files you obtained from us, and ask for a full refund. You will get your money back. That’s a firm promise and commitment.

Subscription Cancellations

If you want to cancel a subscription you have with us, please visit My Account >My Subscriptions, and click on “Cancel Membership”.

When you cancel a subscription with us, you will continue to receive your subscription benefits until the end of the current billing period. You will not receive a refund of any portion of the subscription fees you paid for the current or prior billing periods.

Example 1: monthly subscription cancellation

If we process a monthly subscription’s cancellation on January 7th, you will continue to receive the benefits of that subscription until February 6th (30 days) and there will not be a refund of any part of the monthly subscription fee. You will neither be billed for nor receive the benefits of the cancelled subscription after your current billing cycle ends.

Example 2: yearly subscription cancellation

If we process an yearly subscription’s cancellation after 30 days of the first day of the subscription that begins June 1, you will continue to receive the benefits of that subscription until May 31st of the next year and there will not be a refund of any part of the yearly subscription fee. You will neither be billed for nor receive the benefits of the cancelled subscription after your current billing cycle ends.

Do not wait until the end of a billing or subscription period to make a subscription cancellation request because such requests are typically processed within 2 to 3 business days after we receive them. As it takes longer for us to receive postal mail than electronic mail, we recommend that you email your request. Providing us with your account/subscription number (if you have one) can also speed up the process of honoring your request.

We will confirm your subscription has been cancelled by either email or postal mail.

Email your refund or subscription cancellation request to team@mypetcarecommunity.com. Please include the words “Refund Request” or “Subscription Cancellation Request” in the subject line of your email.

To serve you and others better in the future, we request (but do not require) that you tell us why you want a refund or cancelled your subscription. We want satisfied customers.

Please remember that asking for a refund but continuing to use products purchased from us is the same thing as stealing and may also violate applicable intellectual property rights law.
